1. Identification
This site which can be access via the http://www.noirbasic.com URL, hereafter referred to as “the Site” is published by SARL MR PARIS, a company organized and existing under the laws of France detaining a capital of 43,000Eur, registered in the “registre du commerce et des societes” of Nanterre under the identification number RCS 2008 B 04355, whose registered head offices are located: 41, rue Charles Laffite, 92200 Neuilly-sur-Seine.
The director of publication of the Site is: Romain Bernardini, General Manager of SARL MR PARIS.
The Site hosting is carried out by 1AND1 INTERNET SARL, head offices are located: 7 place de la Gare, 57200 Sarreguemines, France.
Site access and usage of Site content are subject to the usage stipulation provided hereinafter. When an Internet user accesses and browses the Site, he implicitly agrees to the following stipulations completely and without reserves.
2. Copyright/Intellectual property
MR PARIS SARL is the owner of the domain name http://noirbasic.com. The Site in its entirety as well as its components (including texts, structure, animated items, photographs, illustrations drawings graphic representations, etc.) are creative works protected by articles L.111-1 et seq. of the French Intellectual Property code.
The Site and its components are the sole property of MR PARIS SARL/NOIR BASIC the sole entity authorized to exercise the intellectual property rights and personality rights related, including brands, models, copyrights and image rights as the originator or through formal authorization or license.
Use of all or part of the Site, in particular by means of downloading, reproduction, transmission, representation or circulation for purpose other than personal and private use with a non-commercial aim by the internet user, is strictly prohibited. The party liable for infringement of the above shall be liable to penalties stipulated in both the French Intellectual Property code with regard in particular to copyrights infringement (article L.335-3) and trademarks (article L.716-9) and the French Civil code with regards to general liability (article 9, article 1382 et seq.)
It is forbidden to create any and all hypertext links to any one of the web pages or components of the Site without prior authorization from MR PARIS SARL/NOIR BASIC. Said authorization may be withdrawn at any moment. Any and all sites with hypertexts links to the Site or to any one of its components shall not be under the control of MR PARIS SARL/NOIR BASIC. MR PARIS SARL/NOIR BASIC formally declines any liability (in particular with regards to editorial content) concerning access to, and the contents of, such sites.
3. Data of personal nature
MR PARIS SARL/NOIR BASIC is committed to preserving the confidentiality of any information provided on line by Internet users. All personal information that an Internet user transmits to MR PARIS/NOIR BASIC in exchange for the Site’s services is subject to French legislation (Loi #78-17 Informatique et Libertes du 6 Janvier 1978 amended in 2004). MR PARIS SARL/NOIR BASIC may create a “cookie” (alphanumeric identifier) in the hard disk of the Internet user solely with the aim of recognizing the said user when he or she subsequently views the Site. 4. Liability
MR PARIS SARL/NOIR BASIC shall undertake to ensure to the best of its ability the accuracy and updates of the information published on the Site, concerning which the company reserves the right to correct content at any time and without prior notification. 5. Amendments to legal statements
MR PARIS SARL/NOIR BASIC informs internet viewing the Site that these legal statements may be amended at any time. Such amendments shall be published by means of putting them on line and shall be deemed accepted without reserve by any and all internet users accessing the Site after the said amendments have been put on line.
6. Disputes
These legal statements have been drawn in accordance with French law and in particular the provisions of Law #2004-575 dated June, 21st 2004 “for confidence in digital economy” and Law #78-17 dated January, 6th 1978 on “freedom of information and technology” amended by Law #2004-801 dated August, 6th 2004 “regarding the protection of natural persons with regard to processing data of a personal nature”.
French courts shall exercise jurisdiction over any and all disputes arising from the Brussels Regulation dated December 20th 2000 concerning court jurisdiction and the application of rulings. In case of any protest with regards to the conclusion, the performance, the interpretation or the termination of this agreement, both parties agrees to confer exclusive jurisdiction and venue to the court of Justice that has competency over this particular matter in Paris.
